Terms and Conditions

General terms and conditions of Hippie Monkey. 

These terms and conditions apply to all of the orders and transactions that are made with Hippie Monkey. By placing an order at Hippie Monkey, the customer agrees with the terms and conditions of Hippie Monkey. 

1. Definitions 

The definition 'Hippie Monkey' refers to the company of Hippie Monkey. 

The definition 'customer' refers to the company or person who has placed an order at Hippie Monkey. 

2. Customers

Customers of Hippie Monkey has to fill in the wholesale registration form on the website of Hippie Monkey. Afterwards Hippie Monkey will review there application and will decide if the company/person will be an approved customer of Hippie Monkey. Hippie Monkey has the right to refuse customers without any given reason. To become a customer of Hippie Monkey, the customer has to sign a contract that include the terms and conditions of Hippie Monkey. After signing the contract and getting approved, the customer will get there own login to the website of Hippie Monkey and can place orders. 

3. Pricing 

The prices on the website of Hippie Monkey are always stated excluding taxes, because the prices are wholesale prices. When the customer has placed their order, the taxes will be calculated afterwards. Because Hippie Monkey is an European Company based in The Netherlands, all prices are stated in euro's. All the prices on the website of Hippie Monkey are without any obligation and Hippie Monkey can change the prices without any given reason without notifying the customers. 

4. Orders

The customer can place an order at the website of Hippie Monkey. There is no minimal order spend. When the customer places the order, the customer has to fill in all the correct company information, adres and invoicing details. If the customer has filled in the wrong information and changes has to be made afterwards, Hippie Monkey can charge the customer extra fees to make the changes. When the customer has filled in all the information correctly and has approved the terms and conditions, the order will be confirmed. The customer will receive the invoice through email. Hippie Monkey only ships out the order after the customer has fulfilled the full amout of the invoice.

Payment must be made within 14 days of the invoice date. If the payment term is exceeded, all judicial and extrajudicial collection costs will be borne by the customer. In all cases a claim may be charged for extrajudicial collection costs. If the customer is in default with any payment towards Hippie Monkey, Hippie Monkey has the right to suspend the further execution of the agreement and any other current agreements, or, insofar as not executed, to cancel them, without prejudice to our right to compensation.

Hippie Monkey also provides sourcing to an exclusive group of customers. If a customer is looking for a specific product, Hippie Monkey can try to produce it. Sourcing only applies on big orders and when placing the order the order can not be cancelled by the customer under any circumstances. The customer has to pay the full amount on the invoice in advance. The delivery time of the order can change due to different circumstances and third parties of Hippie Monkey. The customer can not get any compensation if the delivery of the order is delayed. 

5. Shipping 

Hippie Monkey will ship the order when the customer has given all the necessary information and has payed the full amount of the invoice. The shipping costs will be calculated after placing the order and will be stated at the invoice. The shipping costs can be subject to change without prior notice. 

Hippie Monkey will deliver the orders as quickly as possible. Shipping time can be subject to change depending on the carriers and third parties. Exceeding the delivery time does not give the customer the right to cancel the agreement or get any form of compenstation. 

If Hippie Monkey is unable to deliver (a part of) your order due to availability, the customer service team of Hippie Monkey will contact the customer with the expected delivery date. All the expected delivery dates that are communicated are estimates and not a guarantee, because Hippie Monkey is depending on third parties to carry our goods to our warehouses. We cannot schedule a specific delivery time. therefore, the customer is responsible for being present during the delivery of the package. If a package is returned because the customer is not present or the package is not collected at a service point, the package will be resent and the additional shipping costs will be charged. Hippie Monkey does not accept returns.

In case Hippie Monkey is not able to deliver in case of availability and the customer doesn't want to wait, the customer can cancel the products that are not available in the order. Hippie Monkey will give a full refund for the products that can't be delivered. In case of exceeding delivery time because of placing pre-orders, big orders or sourcing products, the customer does not have the right to cancel te order. 

6. Returns

Hippie Monkey is working hard for the best quality products and service. The products of Hippie Monkey are made from natural materials and are made by hand. This means every product is unique and there can be differences in every product, regarding colour, design and material. Hippie Monkey will not take any returns. 

When the customer has placed a dropship order and the end customer would like to return the product, the customer has to take the return. The customer has the responsibility of all the returns and has to let their end customer know about the return procedure. Hippie Monkey will not take any returns from dropship orders. 

If a product is damaged and the customer wants to return the product, the customer can contact the customer service team of Hippie Monkey immediatly after the delivery. When the damaged products isn't reported within 3 days after delivery to the team of Hippie Monkey, all rights to a new product or any form of compensation expire. The customer has to send there order number, the description of the damage product and has to add pictures of the package and the product. The customer is responsible for checking the order when the product is delivered. Hippie Monkey does not guarantee products. 

When the customer service team approved the damage of the product, the customer has to return the product within 3 days after delivery in the original packaging. When the package has returned to Hippie Monkey, Hippie Monkey will exchange the product for a new one of give the customer a full refund of the cost price of the damage product. 

7. Cancellation

Hippie Monkey reserve the right to cancel agreements in whole or in part in the event of such a change in circumstances that performance can no longer reasonably be required of us. In such cases, we must inform the customer of the cancellation in writing. In such cases, the latter is not entitled to claim compensation.

When the customer has placed the order at Hippie Monkey, the customer can't cancel the order. Only when the order can't be delivered due to availablity, the customer can choose to cancel the order, but this is not applying on pre-orders, sourcing and big orders. 

8. Products 

The products of Hippie Monkey are made from natural materials and are made by hand. This means every product is unique and there can be differences in every product, regarding colour, design and material. Because of the use of natural materials the products are fragile and should be handled with care. The customers are reliable to inform there end customers about the type of products and the use of it. 

9. Copyright 

All the content on the website of Hippie Monkey or any of the Hippie Monkey Social Channels (Instagram, Facebook, Pinterest, LinkedIn) are the property of Hippie Monkey.  Any use of the content is only allowed when Hippie Monkey has approved and has given there permission to the customer. If you are a customer of Hippie Monkey, the customer has to ask for permission first. 

Customers of Hippie Monkey can use the information and pictures of the products that they are actually selling in there (online) store or social media accounts. Only under the condition that Hippie Monkey is mentioned as the brand in the description and the official social media account of Hippie Monkey is tagged in the picture and description. 

Customer that are dropshipping the products of Hippie Monkey can use the content of the products under the same conditions as stated above, but the customer service team of Hippie Monkey will approve the content of the products in there (online) store, before the customer can starts dropshipping the products of Hippie Monkey. 

If you are not a customer of Hippie Monkey you are not allowed to use any of the content of Hippie Monkey. This is scrictly forbidden and Hippie Monkey can give you a fine for each day the content has been used.

10. Information

Hippie Monkey is trying to give the best content and information as possible to there customers. Information on the website of Hippie Monkey or any other material/channel is deemed to be non-binding. Hippie Monkey is free to change the information at any time without prior notice. Hippie Monkey can not be held liable for errors and has the right to change the prices and specifications without prior notice. 

11. Product Ownership & Clause 

The customer is not allowed to copy any of the products form Hippie Monkey. Hippie Monkey is working hard to create an unique collection of hand made interior items. Copying the products of Hippie Monkey is not allowed. By agreeing to the terms of conditions of Hippie monkey the customer is stating that they will not ever copy any of the products of Hippie Monkey. 

12. Marketplaces 

If a customer wants to sell the products of Hippie Monkey on any other place then there own (online) store, they have to get permission of Hippie Monkey. Only a select group of customers can sell the products of Hippie Monkey to Marketplaces around the world. If the customer is interested to sell on a marketplace, the customer can send a message to the customer service team of Hippie Monkey and they will review your request. Only after approval of Hippie Monkey the customer can sell on the Marketplace that is approved. Again all the copyright terms and conditions are applied when selling on Marketplaces. 

13. Complaints 

Hippie Monkey wants to deliver the best quality products and service, to maintain happy customers all over the world. If a customer has a complaint the customer can send a message to the customer service team by filling in the contact form or send an email to info@hippie-monkey.com. Hippie Monkey will do there best to resolve the complaint of the customer and reply to the complaint within 3 working days. 

14. Guarantee

Hippie Monkey will guarantee that all goods delivered by us meet the normal requirements of usability, reliability and durability, taking into account the nature of the goods. All our warranty obligations lapse if the goods are not in accordance with their destination or improperly or are used, instructions for use have not been observed, improper repairs have been made, changes have been made. All the products of Hippie Monkey are made by hand and made of natural materials. This means that every product is unique. We do not give any warranty. The customer is responsible to check the products on delivery and to inform their end customers about the use and fragility of the products of Hippie Monkey. 

15. Liability 

Our liability under all agreements concerning all goods delivered by us is in all circumstances limited to the price for which the goods in question were delivered. Only damage to goods itself is eligible for compensation, any indirect damage, for example profits lost as well as compensation for damage to third parties is always excluded.

16. Force Majeure 

Unforeseen circumstances with regard to persons and/or materials that we use or tend to use in the execution of the agreement are assimilated to force majeure, which are of such a nature that the execution of the agreement becomes impossible, or so difficult and / or disproportionately expensive that prompt compliance with the agreement cannot reasonably be required of us. Such circumstances include: government measures, operation, traffic and/or transport disruptions, malfunctions in the delivery of finished products, raw materials and/or aids, strikes, lockouts, obstacles by third parties, technical complications unforeseen by both parties, climatic conditions, etc. If it becomes impossible due to such circumstances for Hippie Monkey to deliver the ordered items in whole or in part within a reasonable timespan, the customer’s liability will be limited to the value of the items already delivered, increased by any associated shipping costs.

17. Applicable Law 

All these agreements are subject to Dutch law. The applicability of the Hague Conventions on the International Sale of Trade is expressly excluded.

18. Privacy Policy 

By placing an order with Hippie Monkey, the customer agrees with the Privacy Policy of Hippie Monkey. 

19. Cookie Policy 

When the customer visit the website of Hippie Monkey for the first time, a notice is displayed in which we explain why we use cookies (the cookie banner). The customer can disable the cookies at any time via the internet browser. The website of Hippie Monkey may no longer work optimally after disabling the cookies. For more information about our cookies, please refer to our cookie policy. 

20. Changes 

All the information in the Terms and Conditions of Hippie Monkey l is deemed to be non-binding. Hippie Monkey is free to change the information at any time.
